DEED OF POSTPONEMENT

So that your new lender ("Lender") can obtain a sufficient security we need to put in place a document in respect of the Floating Charge that

your bank holds over your company and effectively the property which you wish to offer as security to the Lender.

Provided that your Bank will accept the most straightforward version of the document providing the Lender with the priority they require, then the work that is required as follows:

  • Preparation of a Deed of Postponement
  • Sending this to your bank for signing
  • Receiving this from your bank properly signed
  • Registering the Deed of Postponement in the Companies Register as an alteration to the Floating Charge

If work can be restricted to this amount, then the cost will be £300 + VAT (£360) with the Company registration costs of £15.

If work extends beyond these parameters, you will appreciate that costs will increase. If some major issue arises, we will revert to you to provide a separate quotation. Otherwise, extra time will be charged at an hourly rate of £160 + VAT (£192). However, there would be a cap on additional costs more than £150 + VAT (£180) without obtaining your prior written approval so you know there is no open-ended charging.
